Agreement

By using ZKyNet's website or platform, you agree to these terms. If you do not agree, do not use the service. ZKyNet is operated by 17204671 Canada Inc., governed by Canadian law.

By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Refund Policy.

What ZKyNet provides

ZKyNet is a tunnel management platform. It provides tools to manage multiple encrypted tunnel connections, configure routing rules, and import configuration files from third-party providers. ZKyNet also provides its own default tunnel infrastructure.

ZKyNet includes its own encrypted tunnel infrastructure and supports importing configurations from third-party providers. Its primary function is managing and routing traffic across multiple tunnels from various sources.

Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and use ZKyNet's services. By using the Service, you represent and warrant that you meet this age requirement.

Account responsibilities

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us promptly if you believe your account has been compromised.

Payment, billing, and renewal

Upon launch, ZKyNet plans to offer monthly ($4 CAD/month) and annual ($35 CAD/year) subscription plans. These prices are estimates and may change before the Service becomes generally available. All subscriptions will renew automatically at the end of each billing period. You authorize ZKyNet to charge the applicable subscription fee at each renewal.

All prices will be listed in Canadian Dollars (CAD). If you pay in another currency, your payment provider may apply its own conversion rate. Applicable taxes will be calculated and added at checkout based on your jurisdiction.

Payments will be processed by Stripe. ZKyNet will accept card payments only at launch. ZKyNet does not store your full payment details.

If your payment method fails, your account access will continue until the end of your current paid period and will not renew.

We will notify you by email of any price changes before your subscription renews at the new rate. You may cancel before the renewal date if you do not accept the new price.

Refund and cancellation

We offer a 30-day money-back guarantee on your initial payment, available once per account. You may cancel your subscription at any time, and your access will continue through the end of the current billing period.

Acceptable use

You agree to use ZKyNet for lawful purposes only. Specifically, you will not use the service to:

  • Transmit malware, viruses, or other harmful code
  • Conduct attacks against networks, servers, or services (including denial-of-service attacks)
  • Distribute illegal content
  • Send spam or unsolicited bulk communications
  • Attempt to gain unauthorized access to systems or data
  • Interfere with or disrupt ZKyNet's infrastructure or other users' access
  • Violate applicable laws or regulations

ZKyNet includes built-in abuse prevention systems that operate at the tunnel level. These protections maintain network quality for all users without inspecting the content of your traffic.

Third-party configurations

ZKyNet allows you to import tunnel configurations from third-party providers and self-hosted servers. Your use of those tunnels is subject to the respective provider's terms of service. ZKyNet is not responsible for third-party tunnel connections, their availability, or their policies.

Service availability

We aim to maintain reliable service but do not guarantee uninterrupted availability. ZKyNet may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

Intellectual property

ZKyNet's software, documentation, and all associated content are the intellectual property of 17204671 Canada Inc. The ZKyNet name, logo, and brand identity are trademarks of 17204671 Canada Inc. You may not use these trademarks without written permission.

Limitation of liability

ZKyNet is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, security, accuracy, and non-infringement.

To the maximum extent permitted by law, 17204671 Canada Inc. shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:

  • Your use or inability to use the Service
  • Unauthorized access to or alteration of your transmissions or data
  • Statements or conduct of any third party on the Service
  • Any other matter relating to the Service

This limitation applies whether or not we have been informed of the possibility of such damages. Our total liability for any claims arising from or related to the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless 17204671 Canada Inc. (operating as ZKyNet), its officers, directors, and employees, from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law. This obligation survives termination of your account.

Sanctions and geographic restrictions

The Service is not available to individuals located in, or residents of, any country or region subject to comprehensive sanctions by Canada under the Special Economic Measures Act (SEMA), the United States, or the European Union. By using the Service, you represent and warrant that:

  1. You are not located in, or a resident of, any such sanctioned country or region.
  2. You are not named on any sanctions list maintained by Global Affairs Canada, the US Office of Foreign Assets Control (OFAC), or the European Union.
  3. You will not use the Service in violation of any applicable export control or sanctions laws.

We reserve the right to terminate your account immediately if we have reason to believe you are accessing the Service in violation of this section.

Termination

We may suspend or terminate your access to ZKyNet if you violate these terms, particularly the acceptable use policy. You may stop using the service at any time. Upon termination, your right to use the service ends, but provisions that should survive (liability limitations, indemnification, dispute resolution) remain in effect.

Upon termination, your data will be deleted within 30 days from active systems and within 60 days from backups.

Dispute resolution

Before filing any legal claim, you agree to first contact us at legal@zkynet.org and attempt to resolve the dispute informally. We will endeavor in good faith to resolve any dispute within 30 days of receiving written notice.

If the dispute remains unresolved after 30 days, either party may pursue resolution in the courts of Ontario, Canada, as set out in the Governing Law section.

Changes to terms

We may update these terms as the product develops. We will provide at least 30 days' notice for material changes via email or website notice. Continued use of the service after changes constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of Canada and the province of Ontario. Disputes will be resolved in the courts of Ontario, Canada.
